These terms apply to all visitors, customers, and others who access our website at lamesaconcreteco.com or use our services.
ClearPath La Mesa Concrete provides concrete contractor services in La Mesa, CA and surrounding areas. Services include, but are not limited to, concrete driveway installation, patio construction, foundation work, sidewalk building, retaining walls, decorative concrete, and related flatwork. All services are subject to availability, project scope, permit requirements, and mutual agreement between ClearPath La Mesa Concrete and the customer.
All estimates provided by ClearPath La Mesa Concrete are based on information available at the time of the site visit or inquiry. Estimates are provided in writing and remain valid for 30 days from the date issued unless otherwise stated.
Final project costs may vary from an initial estimate if conditions change during the project. Such changes include, but are not limited to, discovery of subsurface conditions not apparent during the site visit, changes to the scope of work requested by the customer, or increases in material costs beyond our control. Any changes to the original estimate will be communicated to the customer in writing before additional work proceeds.
Estimates and quotes provided on this website or by phone are not binding contracts. A written agreement signed by both parties constitutes the binding contract for any project.
Project start dates are scheduled after a signed agreement and any required deposit are received. Scheduling is subject to weather conditions, permit approval timelines, and crew availability. We will communicate any scheduling changes as early as possible.
Customers may cancel a scheduled project by providing written notice at least 48 hours before the agreed start date. Cancellations made with less than 48 hours notice may result in forfeiture of any deposit paid to cover mobilization costs already incurred.
ClearPath La Mesa Concrete reserves the right to reschedule or cancel a project if site conditions are unsafe, if required permits are not in place, or if access to the work area is not provided as agreed.
Payment terms are specified in the written project agreement. In general, a deposit may be required to secure a project start date, with the remaining balance due upon substantial completion of the work. Final payment is due within the timeframe stated in the written agreement.
Acceptable payment methods will be communicated at the time of agreement. Invoices not paid within the agreed timeframe may accrue a late fee as permitted under California law.
In the event of non-payment, ClearPath La Mesa Concrete reserves the right to pursue collection through all legal means available, including the filing of a mechanic lien against the property where work was performed, as permitted under California law.
Where required, ClearPath La Mesa Concrete will obtain the necessary permits prior to beginning work. Permit fees are the responsibility of the customer and will be itemized in the written estimate. The customer is responsible for ensuring that property lines, easements, and any homeowners association requirements are understood before work begins. Work performed based on inaccurate information provided by the customer is not the responsibility of ClearPath La Mesa Concrete.
ClearPath La Mesa Concrete warrants that all work will be performed in a workmanlike manner consistent with industry standards for concrete work in Southern California. Any warranty terms, including duration and coverage, will be stated in the written project agreement.
Concrete is a natural material subject to minor cracking as it cures and as ground conditions change over time. Hairline cracks that appear during the normal curing process are not defects. Control joints are placed to direct where cracking is most likely to occur, but cannot guarantee the location or absence of all cracking.
Warranty coverage does not apply to damage caused by misuse, overloading the surface beyond its designed capacity, tree root intrusion, customer-directed changes made after project completion, or conditions that were not apparent or disclosed at the time of the estimate.
To the fullest extent permitted by law, ClearPath La Mesa Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this website or from services provided, including loss of use, loss of income, or property damage not directly caused by our negligence.
Our total liability to any customer for any claim arising out of a project shall not exceed the total amount paid by that customer for the specific project giving rise to the claim.

In the event of a dispute between a customer and ClearPath La Mesa Concrete, both parties agree to first attempt to resolve the matter informally by contacting us directly at contact@lamesaconcreteco.com. We will make a good-faith effort to address concerns within 10 business days of receiving written notice.
If informal resolution is not successful, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, or through the appropriate court in San Diego County, CA, as mutually agreed. Each party shall bear its own costs unless a court or arbitrator awards otherwise.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought in the courts located in San Diego County, California.
We may update these Terms and Conditions from time to time. When we do, we will post the revised terms on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
